1) Account activation
Your account will be activated as soon as we receive your payment and have your order screened incase of fraud. It is your responsibility to provide us with the valid email that is not @ the domain you are signing up under. In case you give false contact information your account will be terminated. In high risk transactions of any kind it is essential to provide a copy of the government issued identification and a copy of the credit card used for the buy. Otherwise the order will be denied as fraudulent.
Transfers
The transfers are provided as a goodwill gesture, we do not give any guarantees concerning the accessibility, possibility, or time necessary to complete a transfer. There are cases when we can’t transfer data from your old host. Some hosting platforms save data in an incompatible format, which makes it nearly impossible to migrate an account data. You have 30 days from your signup to claim free transfer service.
2) Content
All services delivered by Happy@Net may be used only for legal purposes. The customer agrees to secure Happy@Net from any complaints connected with the use of its services.
It is prohibited to use our services to infringe upon any trademark or copyright. The attempt to sell any counterfeit goods will lead to the immediate annihilation of your account.
 
It is not allowed to use an account as a backup/storage device, apart from a cPanel backup of the same account.
 
All our services, related equipment, network devices are provided only for authorized customers. Happy@Net systems may be monitored for legal purposes, to ensure the use is authorized, to confirm survivability and operational security. During monitoring, information may be examined, recorded, copied and used for authorized purposes. Subscribing to our services you consent to monitoring for these purposes.
We reserve the right to refuse service to anyone. Any material that, in our judgment, is obscene, threatening, illegal, or violates our terms of service may be removed from our servers, with or without notice.
 
All abuse issues are to be dealt with via troubleticket/email and will have a response within 48 hours.
 
Failure to respond to email from our abuse department (abuse@happyat.net) within 48 hours may result in the suspension or termination of your services.
 
Potential harm to minors is strictly forbidden, including but not limited to child pornography or content presumed to be child pornography.
 
Any consumer found to host child pornography or linking to child pornography will be suspended immediately without notice.
 
All violations will be reported to the appropriate law enforcement agency.
 
It is your responsibility to ensure that scripts/programs installed under your account are secure and permissions of directories are set properly, not considering installation method. Users are responsible for all actions taken under their accounts. This includes the disclosure of credentials such as username and password. You are required to use a secure password. If a weak password is used, your account may be suspended until you agree to use a more secure password. Audits may be done to prevent weak passwords from being used. If after the audit your password is found to be weak, we will notify you and give you time to change/update your password.
3) Spam Policy
Happy@Net takes a zero tolerance position against sending of unsolicited e-mail and spam of any kind. "Safe lists" and "double opt-in" will be treated as spam. Any user who sends out spam will have their account terminated with or without notice. Please read http://www.happyat.net/mailpolicy.html for our generalized mail policy.
 
Sites advertised via SPAM would not be hosted on our servers. This condition includes, but is not limited to SPAM sent via fax, email, instant messaging, or usenet/newsgroups. No organization or entity listed in the ROKSO may be hosted on our servers. Any account which results in our IP space being blacklisted will be immediately suspended and/or terminated.
 
Happy@Net reserves the right to claim changes or disable as necessary any web site, account, database, or other component that does not correspond to its policies, or to make any such modifications in an emergency at its sole judgment.
 
Happy@Net reserves the right to charge the holder of the account used to send any unwelcome e-mail a clean up fee. The cost of the clean up fee is entirely at the discretion of Happy@Net.
4) Payment Information
A customer agrees to supply appropriate fee for the services received from Happy@Net, in advance of the time period during which the services are provided. A customer agrees that until and unless they notify Happy@Net of their wish to cancel any or all services received, those services will be paid for on a recurring basis.
 
Cancellations must be done via the cancellation form provided. Once we receive your cancellation and have confirmed all necessary information with you via e-mail, we will inform you that your account has been canceled. Your cancellation confirmation will contain a ticket/tracking number in the subject for your reference, and for verification purposes. You should immediately receive an automatic "Your request has been received..." email with a tracking number. An employee will confirm your request and process your cancellation shortly thereafter. We require that cancellations of service are done through the online form to (a) confirm your identity, (b) confirm in writing you are prepared for all files/emails to be removed, and (c) document the request.
 
It is clients responsibility to ensure that their payment information is up to date, and that all invoices are paid on time. Happy@Net provides a 10 day grace period from the time the invoice is due. Any invoice that is overdue for 10 days and not paid will result in a $10 late fee and/or an account suspension until account balance has been paid in full.
 
Invoices that have been paid more than once with multiple Paypal Subscriptions can only be added as credit towards the account and cannot be refunded via Paypal.
 
Happyat reserves the right to change the fees at anytime.
5) Backups and Data Loss
Happy@Net is not responsible for files and/or data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on Happy@Net servers.
6) Cancellations and Refunds
Customers may quit at any time via a cancellation form. Happy@Net gives a 45 day money back guarantee for any customer who paid the first invoice with a credit card or with Paypal.
 
Happy@Net reserves the right to cancel the account at any time with or without notice.
 
The following methods of payments are non-refundable, and refunds will be posted as credit to the hosting account:
  • Bank Wire Transfers
  • Western Union Payments
  • Checks
  • Money orders
There are no refunds on administrative fees, install fees for custom software, or domain name purchases.
 
Only first-time accounts are eligible for a refund. If you've had an account with us before, canceled and signed up again or if you have opened a second account with us, you will not be eligible for a refund.
 
Violations of the Terms of Service will waive the refund policy. Any abuse of our staff will result in the suspension or termination of your services.
7a) Resource Usage
User may not:
a) Use 25% or more of system resources for longer then 90 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc.
b) Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
c) Run any type of web spider or indexer (including Google Cash / AdSpy) on shared servers.
d) Run any software that interfaces with an IRC (Internet Relay Chat) network.
e) Run any bit torrent application, tracker, or client. You may link to legal torrents off-site, but may not host or store them on our shared servers.
f) Participate in any file-sharing/peer-to-peer activities
g) Run any gaming servers such as counter-strike, half-life, battlefield1942, etc
h) Run cron entries with intervals of less than 15 minutes
 
When using PHP include functions for including a local file, enclose the local file rather than the URL. Instead of include("http://yourdomain.com/include.php") use include("include.php")
7b) INODES
The use of more than 50,000 inodes on any shared account may potentially result in suspension. Accounts found to be exceeding the 50,000 inode limit will automatically be removed from our backup system to avoid overusage. Every file on your account uses up to1 inode.
 
Sites that slightly exceed our inode limits are unlikely to be suspended; however, accounts that constantly create and delete large numbers of files on a regular basis, have hundreds of thousands of files, or cause file system damage may be flagged for review and/or suspension.
The primary cause of excessive inodes seems to be due to users leaving their catchall address enabled, but never checking their primary account mailbox. To disable your default mailbox, login to cPanel and choose "Mail", then "Default Address", "Set Default Address", and then type in: :fail: No such user here
8) Bandwidth Usage
Every month certain bandwidth is allowed to you and it depends on the hosting package you want to purchase. Each time your account pass the given amount we have the right to suspend your account until: 1) the next allocation starts; 2) additional bandwidth is purchased; 3) your package is upgraded.
 
We can also terminate your account in case of overage or charge an additional fee.
9a) Refund Guarantee
Happy@Net guarantees to give your money back. In case you are not satisfied with our service during 45 days you can get a full refund. But you should know that it works only with monthly shared packages and not with install fees, domain name purchases or administrative fees.
9b) Uptime Guarantee
If your server is an active one and your uptime is not less than 0,1% you have a possibility of getting a credit for a month. In order to request a credit you need to contact our administration via email. Your server stats will be checked and in case everything corresponds the terms you will get your credit.
10) Shared (non-reseller accounts)
If you want to resell web hosting you can do it using only reseller account. Shared accounts don’t have the right to resell the hosting to others.
11) Price Change
The cost of the hosting will not be changed from the date you made a purchase. But we have the right to change existing prices listed at Happyatnet.com at any time.
12a) Indemnification
The customer agrees to protect Happy@Net and preserve it from any actions directed at it and any claims which can rise because of service or product purchased by customers, their agents or assigns.
 
The customer agrees to protect and preserve Happy@Net from liabilities arising out of: 1) harm to a person or property induced by the products which are sold by or distributed with the help of Happy@Net; 2) any content provided by customer violating the rights of a third party; 3) copyright breach; 4) any faulty product sold from Happy@Net’s server.
12b) Arbitration
Using Happy@Net's service you agree to submit to arbitration. This means that in case there are any claims or disputes concerning Happy@Net they will be handled by the arbitrator chosen by Happy@Net. The arbitrator, either from American Arbitration Association or the National Arbitration Forum is to be selected in Texas. An arbitrator should be selected according to suitable rules and should be an attorney or a retired judge. All the judgments passed by the arbitrator would be final and obligatory. The arbitration is governed by the Federal Arbitration Act under this Arbitration Clause.
13) Disclaimer
Happy@Net has no responsibility for the damages of your business in process of using our service. This includes loss of data connected with improper or wrong delivery and any other kinds of service failures caused by Happy@Net and its employees.
14) Disclosure to law enforcement
Happy@Net reserves the right to reveal the information about any subscribed person to law enforcement agencies without notification and previous consent with the subscriber. Happy@Net will completely collaborate with law enforcement agencies.
15) Changes to the TOS
Happy@Net has the right to modify its policy without notification at any time.
